Business Trademark In Nepal
Business Trademark In Nepal : Do you want to brand your industry or brand your products and make them safe? If so, the name or product can be secured by registering a trademark. An application for trademark registration must be submitted to the Department of Industry under the Ministry of Industry, Commerce and Supplies. When submitting the application, you should submit the trademark sample of the design you want to take in the format prescribed by the department.
Officials of the industrial property branch of the department conduct a preliminary study of the application. If there are any errors in the study, additional required documents are required and in case of obvious ones, a substantive test is conducted. Based on all the facts of the industry in the essential study, the department finalizes and publishes the design of the trademark in the industrial bulletin.
The bulletin made public by the department is also placed on the information board of the department from the umbrella organization of entrepreneurs. When the bullet is made public, a period of 90 days is given to protest the claim. If the design that has been made public seems to match someone else’s, word and color, you can file a complaint with the department with the basis of disclosure of evidence.
If no one’s claim is opposed to the design that has been made public within 90 days, the department issues a trademark certificate. Under the Patents, Designs and Trademarks Act 2022, any company can take a trademark. The department provides this facility after taking the application to keep the trademark of the goods produced by them. A trademark can be a word or a logo. But if the trademark you want to get is already registered in the industry department, you cannot get a new registration.
