Human Rights: Complete Loksewa Notes (English)
Human rights is one of the most frequently asked topics in Nepal’s Public Service Commission (Loksewa Aayog) exams. Candidates for Section Officer, Nayab Subba and Kharidar meet it in both objective and subjective questions. These human rights notes for Loksewa cover the concept, history, Nepal’s constitutional provisions, the National Human Rights Commission and practice questions.
1. What are human rights?
Human rights are the basic rights every person holds simply by being human. No one grants them and no one can take them away. They apply equally regardless of caste, gender, religion, language, colour, nationality or wealth. The state’s core duty is to respect, protect and fulfil them.
In simple terms, human rights are the minimum conditions for living with dignity. Nepal’s National Human Rights Commission Act, 2068 (2012) defines them as rights relating to life, liberty, equality and dignity guaranteed by the Constitution, other laws and international treaties to which Nepal is a party.
2. Key features
- Universal: they apply to every human being everywhere.
- Inalienable: they cannot be sold, transferred or surrendered.
- Indivisible: civil, political, economic, social and cultural rights carry equal weight.
- Interdependent: violating one right affects others.
- Equal and non-discriminatory: everyone enjoys them without distinction.
- State obligation: the state must respect, protect and fulfil them.
3. Three generations of human rights
Czech jurist Karel Vasak proposed this classification in 1979, linking it to the French Revolution’s ideals of liberty, equality and fraternity.
| Generation | Nature | Examples |
|---|---|---|
| First | Civil and political rights (liberty) | Right to life, expression, voting, fair trial |

| Third | Collective or solidarity rights (fraternity) | Right to development, clean environment, peace |
