Public Procurement in Nepal: Complete Loksewa Notes (English)
A large share of the state’s development budget is spent through procurement, which makes public procurement an important topic in Public Service Commission exams for Section Officer, Nayab Subba and Kharidar. Papers on financial administration, public management and good governance carry both objective and subjective questions on it. These public procurement Loksewa notes cover the concept, principles, the Public Procurement Act, 2063 (2007), procurement methods and process, complaints, the Public Procurement Monitoring Office and challenges.
1. What is public procurement?
Public procurement is the process by which public bodies use public funds to obtain goods, works, consulting services or other services. It covers every step from identifying needs, planning and cost estimation to inviting bids, evaluation, contracting, implementation, payment and record keeping.
Because it spends taxpayers’ money, procurement must be economical, transparent and accountable. Weak procurement breeds corruption, delays and poor-quality construction, while strong procurement speeds up development.
2. Principles
- Competition: equal opportunity for all qualified suppliers.
- Transparency: open information, criteria and decisions.
- Economy and efficiency: suitable quality at the lowest cost and on time.
- Value for money: a balance of price, quality and long-term benefit.
- Fairness: no discrimination or favouritism.
- Accountability: clear responsibility and records for each decision.
- Integrity: a process free of conflicts of interest, bribery and collusion.
3. Public Procurement Act, 2063: purpose
Procurement was earlier governed by financial administration rules. The Public Procurement Act, 2063 gave it a single legal framework, and the Public Procurement Rules, 2064 were made under it. Both have been amended several times.
Main objectives:
- Make procurement procedures and decisions open, transparent, objective and credible.
- Promote competition, fairness, honesty and accountability.
- Bring economy and credibility to public spending.
- Give everyone wishing to take part an equal, non-discriminatory opportunity.
- Strengthen the management capacity of public bodies.
4. Scope and types of procurement
The Act applies to federal, provincial and local government offices, constitutional bodies, state-owned enterprises, universities and other bodies run with public funds. Procurement falls into four types:
| Type | Examples |
|---|---|
| Goods | Computers, vehicles, medicines, furniture |
| Works | Roads, bridges, buildings, irrigation canals |
| Consulting services | Feasibility studies, design, supervision |
| Other services | Cleaning, security, transport, maintenance |
5. Steps in the procurement process
- Identify needs and prepare specifications.
- Prepare a master procurement plan and an annual procurement plan.
- Prepare and approve the cost estimate.
- Select the appropriate procurement method.
- Prepare bidding or proposal documents.
- Publish a public notice and invite bids.
- Receive bids and open them in public.
- Evaluate bids through an evaluation committee.
- Issue a notice of intent to award and allow time for complaints.
- Sign the contract after receiving a performance security.
- Manage the contract, test quality, make payments and keep records.
6. Procurement methods
| Goods, works and other services | Consulting services |
|---|---|
| Open bidding (national or international competition) | Quality and cost based selection |
| Limited bidding | Quality based selection |
| Sealed quotations | Fixed budget selection |
| Direct purchase | Least cost selection |
| Through users’ committees or beneficiary communities | Selection based on consultant’s qualifications |
| Force account (amanat) | Single source selection |
| Direct negotiation and other special methods | Selection of individual consultants |
The Rules set the value thresholds for each method, and these are revised from time to time, so always check the latest Rules. The general principle is that larger purchases require more open and competitive methods. Splitting a purchase to avoid competition is not allowed.
7. Evaluation and contracts
- Bids are opened at the set time in the presence of bidders or their representatives.
- Evaluation follows only the criteria stated in the bidding documents.
- The general rule is to accept the lowest evaluated substantially responsive bid.
- Bidders provide a bid security, and the selected bidder provides a performance security.
- Variations, price adjustments and time extensions are allowed only within legal limits.
8. Complaints and review
- A dissatisfied bidder first applies for review to the head of the public entity.
- If still dissatisfied, the bidder can apply to the Review Committee formed under the Act.
- Complaints must be filed within the time limits set by law.
9. Public Procurement Monitoring Office (PPMO)
Under the Act, the PPMO was set up under the Office of the Prime Minister and Council of Ministers. Its main functions:
- Advise the government on procurement policy reform.
- Prepare standard bidding documents, guidelines and standards.
- Monitor procurement by public entities and request reports.
- Run procurement training and capacity building.
- Operate and manage the electronic government procurement (e-GP) system.
- Blacklist bidders and suppliers involved in corrupt or fraudulent practices for a set period, on the recommendation of the entity concerned.
10. Electronic procurement (e-GP)
The e-GP system moves bid invitation, submission, opening and result publication online. It helps prevent obstruction of physical bid submission, intimidation and collusion, increases transparency and saves time and money.
11. Prohibited practices and conduct
- Corrupt practice: giving or taking bribes.
- Fraudulent practice: submitting false documents or misleading information.
- Collusion: bidders agreeing to fix prices or limit competition.
- Coercive practice: using threats or force to influence the process.
- Officials with a conflict of interest must not take part in procurement decisions.
12. Challenges in Nepal
- Procurement plans made without real needs assessment or studies.
- Contractors winning on very low bids and then delaying or abandoning work.
- Single contractors taking on more contracts than they can handle.
- Rushed procurement and payment at the end of the fiscal year (the “Asare” spending problem).
- Collusion, political protection and corruption.
- Shortage of procurement specialists and contract management skills.
- Contractors working under the name of users’ committees.
13. Way forward
- Realistic master procurement plans and multi-year planning.
- Full use of e-GP for every stage.
- Recording contractor performance and using it in evaluation.
- Developing procurement as a professional specialisation.
- Third-party monitoring and public audits.
- Strict enforcement of blacklisting and penalties.
Conclusion
Public procurement is a mirror of good governance and development. The Public Procurement Act, 2063 provides a legal framework for competition, transparency and accountability, but its success depends on honest implementation, skilled staff and effective monitoring. Every public servant must ensure value for each rupee of public money. Revise these public procurement Loksewa notes and practise with the model questions below.
