Federalism and the Three Tiers of Government in Nepal

Federalism and Three Tiers of Government: Complete Loksewa Notes (English)
Federalism in Nepal is the biggest structural change brought by the Constitution of Nepal, 2015, and it is tested regularly in Public Service Commission exams for Kharidar, Nayab Subba and Section Officer. Questions cover the structure of the federal, provincial and local governments, lists of powers, fiscal transfers and intergovernmental relations. These notes cover the concept, types, constitutional provisions, the three tiers, challenges and practice questions.
1. What is federalism?
Federalism is a system in which the constitution divides state power between a central government and regional or local governments, and each acts autonomously within its own sphere. In a unitary system all power sits at the centre and is delegated downwards only at the centre’s will; in a federal system the powers of the lower tiers are guaranteed by the constitution itself.
The essence of federalism is often summed up as “self-rule plus shared rule”: deciding one’s own regional matters while governing national matters together.
2. Key features
- Written constitution setting out the division of powers.
- Two or more tiers of government.
- Constitutional division of powers through exclusive and concurrent lists.
- Supremacy and rigidity of the constitution: no tier can change powers unilaterally.
- Independent judiciary to settle disputes between tiers.
- Bicameral legislature with provincial representation in the upper house.
- Fiscal autonomy through revenue powers and intergovernmental transfers.
3. Types of federalism
| Type | Meaning | Examples |
|---|---|---|
| Coming together | Independent units unite to form a federation | USA, Switzerland |
| Holding together | A unitary state divides power to become federal | India, Belgium, Nepal |
| Dual | Tiers work separately in their own spheres | Early US model |
| Cooperative | Tiers work through cooperation and coordination | Germany, Nepal |
Nepal restructured a unitary state, so its federalism is of the holding-together type, and because the Constitution stresses cooperation it is described as cooperative federalism.
4. Background in Nepal
- People’s Movement of 2062/63 BS and the Madhes Movement: demands for state restructuring and federalism.
- Interim Constitution, 2063 (first amendment): commitment to a federal state.

11. Challenges
- Delays and ambiguity in laws on concurrent powers.
- Staff adjustment problems and shortages at provincial and local levels.
- Weak own-source revenue and heavy reliance on grants.
- Delays in federal civil service, police and education laws.
- A centralising mindset and reluctance to devolve power.
- Duplicated projects and weak coordination between tiers.
- Rising administrative costs and questions of transparency and accountability.
12. Way forward
- Clear laws and detailed unbundling of concurrent powers.
- Build institutional and human capacity at provincial and local levels.
- Mobilise own-source revenue and enforce fiscal discipline.
- Hold regular intergovernmental council meetings and act on their decisions.
- Move towards performance-based grants.
- Promote citizen participation and local accountability.
Conclusion
Federalism is Nepal’s means of decentralising power, deepening inclusion and bringing services closer to citizens. The Constitution makes cooperation, coexistence and coordination the basis of relations among the three tiers. Its success depends on capacity building, fiscal discipline and political commitment.
