Right to Information: Concept and Legal Provisions in Nepal
“गोपनीयता अपवाद, खुलापन नियम” (openness is the rule, secrecy the exception) भन्ने सिद्धान्त यसको मर्म हो।

Right to Information: Complete Loksewa Notes (English)
The right to information (RTI) is tied directly to democracy, transparency and good governance, so it appears often in Public Service Commission (Loksewa Aayog) exams for Section Officer, Nayab Subba and Kharidar. Objective questions test the constitutional article, the year of the Act, response deadlines, appeal periods and the structure of the National Information Commission. Subjective questions ask about the concept, importance and implementation challenges. These notes bring all of it together.
1. What is the right to information?
The right to information is a citizen’s right to request, receive and access information of public importance held by public bodies. It includes the right to inspect and study documents, obtain certified copies, observe public works sites and take samples.
The idea behind it is that government runs on public money, so the information it holds belongs to the people. Its core principle is that openness is the rule and secrecy the exception. RTI is often called the “mother of all rights”, since other rights cannot be used effectively without information.
2. Key features
- Fundamental right: guaranteed by Nepal’s Constitution.
- Citizens’ right: available to Nepali citizens.
- Applies to public bodies: government offices, constitutional bodies, public enterprises, political parties, and NGOs receiving government grants or foreign aid.
- Time-bound: information must be given within fixed deadlines.
- Proactive disclosure: certain information must be published regularly even without a request.
- Narrow exceptions: information can be withheld only in limited cases such as national security, criminal investigation or personal privacy.
- Remedies: refusals can be appealed.
3. Importance
- Increases transparency and accountability in government.
- Helps control corruption and irregularities.
- Enables informed citizen participation in decision-making.
- Gives real meaning to press freedom and freedom of expression.
- Improves service delivery and use of public resources.
- Builds trust between the state and citizens.
4. International background
- 1766 – Sweden: first country to grant access to public documents, through its Freedom of the Press Act.
- 1948 – UDHR Article 19: freedom to seek, receive and impart information.
- 1966 – ICCPR Article 19: freedom of information as part of freedom of expression.
- 2003 – UN Convention against Corruption (UNCAC): stresses transparency and public access to information.
- 2005 – India: Right to Information Act enacted.
- 28 September: International Day for Universal Access to Information.
5. Development in Nepal
- Constitution of the Kingdom of Nepal, 2047 BS (Article 16): first recognised RTI as a fundamental right.
- Interim Constitution, 2063 BS (Article 27): continued the right.
- Right to Information Act, 2064 BS (2007): dedicated law to implement the right.
- Right to Information Regulation, 2065 BS: procedural rules.
- National Information Commission, 2065 BS (2008): established under the Act.
- Constitution of Nepal, 2072 BS (2015), Article 27: RTI retained as a fundamental right.
6. RTI in the Constitution of Nepal, 2015
Article 27 says every citizen has the right to demand and receive information on any matter of personal or public concern, but no one shall be compelled to disclose information that must be kept confidential by law. The right is closely linked to the right to privacy (Article 28) and freedom of opinion and expression (Article 17). If it is violated, a constitutional remedy can be sought under Article 46.
7. Main provisions of the Right to Information Act, 2007
| Topic | Provision |
|---|---|
| Guarantee | Every Nepali citizen has the right to access information held by public bodies |
| Information officer | Every public body must designate an information officer |
| Proactive disclosure | Structure, functions, staff, services, fees, decisions, income and spending to be published every three months |
| Response time | Immediately if possible; otherwise within 15 days of the application |
| Information on life and safety | Within 24 hours |

| Appeal | To the National Information Commission within 35 days; Commission decides within 60 days |
| Classification | A committee led by the Chief Secretary classifies information |
| Whistleblower protection | Employees who disclose corruption or irregularities cannot be punished or harmed |
| Penalty | The Commission can fine officials who withhold or delay information in bad faith and order departmental action |
8. Exempt information
The Act lists five categories of information that need not be disclosed:
- Information that would seriously jeopardise Nepal’s sovereignty, integrity, national security, public peace or international relations.
- Information that would directly affect investigation, inquiry or prosecution of crime.
- Information that would seriously harm economic, trade or monetary interests, intellectual property, or banking and trade confidentiality.
- Information that would directly disturb harmony among castes or communities.
- Information that would interfere with personal privacy or with a person’s body, life, property, health or safety.
A public body that refuses must state adequate and reasonable grounds.
9. National Information Commission
- Nature: an independent statutory body under the RTI Act, 2007, not a constitutional body.
- Composition: a Chief Information Commissioner and two Information Commissioners, with at least one woman.
- Appointment: by the Government of Nepal on a recommendation committee’s advice.
- Functions: hear appeals, order disclosure, fine officials at fault, protect and promote RTI, and issue directions to public bodies.
10. Implementation challenges
- A long-standing culture of secrecy and a “better not to share” mindset among officials.
- Ineffective, under-trained information officers.
- Irregular or merely formal proactive disclosure.
- Low public awareness of the law.
- Weak record management and few digital records.
- Misuse of requests for personal grudges.
- Limited capacity and reach of the Commission and weak enforcement of its orders.
11. Way forward
- Adopt open government and open data practices.
- Make up-to-date proactive disclosure on every agency’s website mandatory.
- Digitise record management.
- Give information officers training, resources and incentives.
- Raise awareness through schools and local governments.
- Extend the Commission’s reach to the provinces and monitor compliance with its orders.
Conclusion
The right to information is the foundation of transparent, accountable and participatory governance. Nepal has a solid legal framework in Article 27, the RTI Act, 2007 and the National Information Commission. What remains is to replace a culture of secrecy with one of openness. Future civil servants should see citizens who ask for information as partners, not nuisances. Revise the RTI deadlines and articles as a table before your exam.
