Local Government and the Local Government Operation Act, 2074: Complete Loksewa Notes (English)
The Local Government Operation Act and the constitutional provisions on local levels are among the most frequently tested topics in Public Service Commission exams for Section Officer, Nayab Subba and Kharidar. As the government closest to citizens, local levels generate both objective and subjective questions on structure, powers, judicial committees and the budget process. These notes cover the concept, constitutional provisions, key features of the Local Government Operation Act, 2074 (2017), fiscal sources and challenges.
1. Concept of local government
Local government is the level closest to people, delivering services, development and governance at their doorstep. The Constitution of Nepal, 2015 treats local levels not as bodies holding powers delegated from the centre, as in the past, but as governments with powers granted directly by the Constitution. Article 56 lists rural municipalities, municipalities and district assemblies as the local level.
Earlier, under the Local Self-Governance Act, 2055 (1999), Nepal had Village Development Committees, municipalities and District Development Committees. After the new Constitution, a Local Level Restructuring Commission proposed the present structure, and the first local elections were held in three phases in 2074 BS (2017).
2. Structure of local levels
| Type | Number |
|---|---|
| Metropolitan cities | 6 |
| Sub-metropolitan cities | 11 |
| Municipalities | 276 |
| Rural municipalities | 460 |
| Total local levels | 753 |
These are divided into 6,743 wards. Each of the 77 districts has a District Assembly and a District Coordination Committee.
3. Local executive (Part 17)
Under Article 214, local executive power is vested in the rural municipal executive or municipal executive.
| Element | Rural municipal executive (Art. 215) | Municipal executive (Art. 216) |
|---|---|---|
| Head | Chairperson | Mayor |
| Deputy | Vice-chairperson | Deputy mayor |
| Ward representatives | All ward chairpersons | All ward chairpersons |
| Women members | 4, elected by the rural municipal assembly | 5, elected by the municipal assembly |
| Dalit or minority members | 2 | 3 |
Heads, deputies and ward chairpersons are directly elected. Each ward elects a chairperson and four members, of whom two must be women, including one Dalit woman. Under Article 225, rural municipal and municipal assemblies have a five-year term from the date of election.
4. Local legislature (Part 18)
- Article 221: local legislative power is vested in the rural municipal assembly or municipal assembly.
- Composition (Articles 222 and 223): the head, deputy, ward chairpersons, four ward members from each ward, and the women and Dalit or minority members of the executive.

- Budget: passes the annual budget and policies and programmes presented by the executive.
5. District Assembly and District Coordination Committee
Under Article 220, the chairpersons and vice-chairpersons of rural municipalities and the mayors and deputy mayors of municipalities in a district form the District Assembly. It elects a District Coordination Committee of up to nine members, including a chief, a deputy chief, at least three women and at least one Dalit or minority member. Its role is to coordinate local levels within the district, liaise with federal and provincial offices and monitor development. It is a coordinating body, not an executive government.
6. Constitutional powers
