CIAA and Corruption Control: Complete Loksewa Notes (English)

The Commission for the Investigation of Abuse of Authority (CIAA) is Nepal’s main constitutional body for controlling corruption, and it is tested regularly in Public Service Commission exams for Kharidar, Nayab Subba and Section Officer. Constitution, governance and general knowledge papers ask about its composition, powers, the concept of corruption and the related laws. These notes cover the concept of corruption, the history of the CIAA, constitutional provisions, legal and institutional mechanisms, challenges and practice questions.

1. What is corruption?

Corruption is any improper, illegal or unethical act that uses public office or authority for personal gain or the gain of others. Transparency International defines it as “the abuse of entrusted power for private gain”; the World Bank describes it as “the abuse of public office for private gain”.

Corruption wastes public resources, lowers service quality, deepens inequality and erodes citizens’ trust in the state. It is therefore seen as the biggest obstacle to good governance and development.

2. Types and forms

Type Meaning
Petty corruption Small bribes in everyday service delivery
Grand corruption High-level corruption in large projects, procurement and policy
Policy corruption Making policies or laws to benefit a particular group
Political corruption Improper use of money in elections, party finance and gaining power
Systemic corruption Corruption embedded in institutions and processes

Common forms include bribery, commissions, illegal gain, nepotism and favouritism, embezzlement of public property, revenue leakage, illicit enrichment and fake certificates.

3. Causes

  • Weak law enforcement and impunity.
  • Political protection and election spending.
  • Complex procedures and excessive discretion.
  • Lack of transparency and accountability.
  • Low pay and consumerist social values.
  • Lack of ethics education and social sanction.

4. History of the CIAA

  • 2016 BS: a Special Police Department set up to control corruption.
  • 2017 BS: the Prevention of Corruption Act, 2017 enacted.
  • 2032 BS: after the third amendment to the Constitution of Nepal, 2019, a Commission for the Prevention of Abuse of Authority was formed.
  • 2033 BS (1977): the Commission for the Investigation of Abuse of Authority established under the constitution.
  • Constitution of the Kingdom of Nepal, 2047: the CIAA strengthened as an independent constitutional body.
  • CIAA Act, 2048 (1991): the main law setting out the Commission’s procedures.
  • Interim Constitution, 2063 and Constitution of Nepal, 2072: continued as a constitutional body.

5. Constitutional provisions

Part 21 of the Constitution, Articles 238 and 239, deals with the CIAA.

  • Composition (Article 238): a Chief Commissioner and other commissioners as needed, appointed by the President on the Constitutional Council’s recommendation after a parliamentary hearing.
  • Term: six years from appointment. The office falls vacant on reaching 65, resignation, impeachment, removal for physical or mental incapacity, or death.
  • Qualifications: a bachelor’s degree from a recognised university, long experience in a relevant field, high moral character and a set minimum age; not a member of any political party.
  • No reappointment: a commissioner may become Chief Commissioner, with the earlier service counted in the term.

6. Functions, duties and powers (Article 239)

  • Investigate, or cause to be investigated, abuse of authority by corruption by any person holding public office.
  • File, or cause to be filed, cases in the competent court where corruption is found.
  • Write to the relevant authority for departmental or other action on improper conduct that is not corruption.
  • Seize documents, take statements and demand property details during investigation.
  • Carry out corruption prevention and awareness work.

Outside its jurisdiction: officials covered by separate constitutional provisions (such as judges under the Judicial Council) and those subject to action under the Army Act. The CIAA Act, 2048 also excludes policy decisions taken collectively by the Council of Ministers.

Annual report: under Article 294 the CIAA submits its annual report to the President, who sends it to the Federal Parliament through the Prime Minister.

7. Legal framework

Under the Prevention of Corruption Act, 2059, penalties include imprisonment, fines and confiscation of the amount involved, depending on the seriousness of the offence, with additional penalties when a public servant is the offender.

  • Policy-level corruption falls outside the CIAA’s jurisdiction.
  • Lengthy investigations and difficulty gathering evidence.
  • No clear law on private-sector corruption.
  • Weak monitoring capacity at provincial and local levels after federalism.
  • Social tolerance of corruption.
  • Weak protection for whistleblowers.

11. Way forward

  • Strengthen the CIAA’s independence, staffing and technical capacity.
  • Reduce face-to-face contact and discretion through e-governance and online services.
  • Verify public officials’ property declarations regularly.
  • Enact whistleblower protection and private-sector anti-corruption laws.
  • Ensure quick and effective verdicts from the Special Court.
  • Teach ethics from school level and raise public awareness.
  • Strengthen the watchdog role of the media and civil society.
  • Publish procurement, budget and project information openly so that citizens can monitor it.
  • Improve coordination between the CIAA, Auditor General, National Vigilance Centre and investigating departments.

Conclusion

Corruption is the enemy of good governance, development and democracy. The CIAA is Nepal’s most powerful constitutional body for fighting it, but punishment alone is not enough; prevention, system reform and public awareness are equally essential.
