Constitution of Nepal 2015: Complete Loksewa Notes (English)

The key features of the Constitution of Nepal, 2072 BS (2015) are a core topic in almost every Public Service Commission (Loksewa Aayog) exam. Candidates for Kharidar, Nayab Subba and Section Officer meet questions on its Parts, Articles, Schedules and constitutional bodies in both objective and subjective form. These notes cover the background, structure, main features, organs of state, constitutional bodies and practice questions.

1. Background

The Constitution of Nepal was drafted by the second Constituent Assembly and promulgated on 3 Ashoj 2072 BS (20 September 2015), now celebrated as Constitution Day. It is the first constitution in Nepal’s history written by an elected Constituent Assembly. Earlier documents were the Government of Nepal Act, 2004; the Interim Government of Nepal Act, 2007; the Constitution of the Kingdom of Nepal, 2015 BS; the Constitution of Nepal, 2019; the Constitution of the Kingdom of Nepal, 2047; and the Interim Constitution of Nepal, 2063. For this reason the current constitution is called Nepal’s seventh.

The first Constituent Assembly, elected in 2064 BS (2008), was dissolved without completing the constitution. A second Assembly was elected in 2070 BS (2013) and adopted the constitution through broad agreement.

2. Structure

Item Number (as promulgated)
Preamble 1
Parts 35
Articles 308
Schedules 9
Fundamental rights 31 (Articles 16–46)
Tiers of government 3 (federal, provincial, local)

The first amendment, passed in 2072 BS, dealt with proportional inclusive representation and the delimitation of constituencies. The second amendment, in 2077 BS (2020), updated the coat of arms in Schedule 3 with a new map including Limpiyadhura, Lipulek and Kalapani.

3. Preamble highlights

  • Sovereignty and state authority rest with the people of Nepal.
  • An end to all discrimination and oppression created by the feudal, autocratic, centralised and unitary state.
  • Commitment to competitive multiparty democracy, civil liberties, fundamental and human rights, adult franchise, periodic elections, full press freedom, an independent judiciary and the rule of law.
  • Commitment to socialism and to building a prosperous nation.
  • Aspiration for lasting peace, good governance, development and prosperity.

4. Main features

  • Written and detailed: every organ, tier and body of the state is set out in writing.
  • Supremacy of the Constitution (Article 1): it is the fundamental law; any law inconsistent with it is void to the extent of the inconsistency.
  • Sovereignty of the people (Article 2).
  • Nature of the state (Article 4): independent, indivisible, sovereign, secular, inclusive, democratic, socialism-oriented, federal democratic republic.
  • Federal structure (Article 56): three tiers, with seven provinces and 753 local levels.

  • Inclusion: guaranteed representation for women, Dalits, indigenous nationalities, Madhesis, Tharus, Muslims, backward classes, minorities and marginalised groups and regions.
  • Mixed electoral system: first-past-the-post (FPTP) and proportional representation (PR).
  • Women’s representation: at least one-third of each party’s members in the Federal Parliament must be women.
  • Independent judiciary: three-tier courts and a Constitutional Bench.
  • Constitutional bodies: 13 bodies including the CIAA, Auditor General, PSC, Election Commission and NHRC.

  • Article 284: Constitutional Council, chaired by the Prime Minister.

11. Implementation challenges

  • Weak enforcement of laws made to implement fundamental rights.
  • Unclear division of powers and weak coordination between the three tiers.
  • Delays in key federal laws on civil service, police and education.
  • Political influence over appointments to constitutional bodies.
